The range of accidents that are covered by the TAC scheme is extensive, and not just limited to car accidents and car drivers. Also included are accidents involving trams, trains, motorbikes, bicycles and even pedestrians. Therefore it does not matter how you were injured in an accident, whether as a driver or as a pedestrian.

What if the Accident was my fault?

The benefits and payments that you may be entitled to as a result of a Dandenong car accident may depend on whether or not the accident was deemed to be your fault. If the accident was your fault, then you will still be entitled to some benefits, which are known as “No-Fault benefits”. These include medical expenses and loss of wages. How long do I have to claim with the TAC?

Claims with the TAC must be made in reasonable time. In exceptional circumstances that can be up to 3 years but in normal cases claims must be made within 12 months of the date of the accident. So you should lodge your claim within 12 months of the date of the accident, otherwise you may lose your right to compensation.

Are there any other time limits I should be aware of?

Yes, there are various other time limits for particular scenarios. If the TAC makes a decision with which you are not happy, which will normally mean refusing part of or your entire claim, then you have 12 months in which to challenge that decision. In those cases, as mentioned above, it is advisable to retain the services and advice of a solicitor who can help you in providing grounds for challenging through an appeal.

A 6 year limitation applies if you are wishing to make a claim for Common law compensation.

Permanent Impairment

If you have suffered a permanent injury than you may be entitled to what is known as impairment benefits. You have up to 6 years to make a claim for impairment benefits.

Although these time limits can sometimes be extended, this is rare and you should not rely on such extensions being granted for your application, meaning that you should apply in time in each case.

What Types of Compensation are Available?

      Medical expenses cover a whole range of in hospital and outpatient services, plus other ancillary costs. For example, medical services cover the cost of an ambulance, either from the scene of an accident to the hospital, or transfer between hospitals should such an expense be necessary for your treatment.

      Medical expenses also cover treatment at a hospital, whether private, public or rehabilitation, visits to a family or specialist doctor, or home visits from nursing services after discharge from hospital.

      Should your treatment require prescription drugs, then they may be covered by the TAC if prescribed by a doctor and provided by a pharmacist. This will also be the case if therapeutic services are part of your recovery, including physical and psychological services. The TAC may also be able to pay for the restoration of teeth damaged in an accident, or the repair or replacement of spectacles and hearing aids.

  2. Income Benefits

      If you are unable to work in the short term then the TAC can pay income support as a temporary help and the reasonable cost of rehabilitation services such as a return to work program. If you lose the capacity to work as a result of your accident, then earning capacity benefits can be paid by the TAC.

  3. Travelling Expenses

      Reasonable travelling costs by public transport or private car may be paid by the TAC in order to help you with the cost of travelling to and from appointments for treatment.

  4. Household Support Services

      If you are unable to do housework as a result of your accident, temporary support may help to fund someone who can help with simple household tasks such as cleaning, gardening, vacuuming etc.

  5. Childcare

      Help may also be available from the TAC to help you when receiving hospital treatment for your injuries to pay for childcare.

      In cases of death and according to the financial circumstances of the family, the TAC may be able to help with funeral costs, counselling services, and even financial support for dependents.
