Road Accident Compensation

Victims of road crashes are able to claim compensation for their injuries, disabilities and losses that are the result of the accident. The amount of compensation and benefits available depends on the individual’s circumstances. Generally speaking, a person may be able to claim compensation for the following losses and expenses:

  • Medical treatment and hospital expenses.
  • Dental expenses, where dental injuries have been caused by the accident.
  • Physical therapy expenses (physiotherapy, chiropractic, osteopathy and podiatry).
  • Counseling expenses, for example if you have suffered shock, anxiety, depression, PTSD as a result of the accident.
  • Loss of income and loss of earning capacity.
  • The cost of travelling to and from your accident-related treatment.
  • Modifications to home and vehicle.
  • The cost of domestic assistance, gardening assistance, and attendant care.
  • Permanent impairment compensation.

Injured Driver

If you were a driver injured in a road crash, we can advise you of your rights to compensation, whether you were the party at fault or not. Drivers have a duty of care to ensure that they do not cause harm to other road users. Drivers should take care when consuming alcohol, and should avoid use of illicit drugs. Heavy drinking and drugs such as speed and ecstasy in particular reduce coordination and affect a person’s ability to adjust speed and distance. These substances can also increase a person’s confidence so they are more likely to engage in dangerous, risk taking behaviour.

Injured Passengers

Passengers injured in a road accident should seek legal advice from a qualified and experienced solicitor. The stress of dealing with the claims process and, in particular with insurance companies who are trying to settle a claim to their best advantage can be overwhelming to the injured party. Our car accident solicitors are understanding and compassionate, and can help guide the injured passenger through the claims process, and ensure that he or she receives maximum compensation for all accident-related injuries and disabilities.

Motorbike Accidents

When looking at injury rates in relation to the number of registered vehicles, motorcyclists have by far the highest rate of serious injury cases. In fact, approximately 54 per cent of injured motorcycle riders are killed or admitted to hospital. The most critical injuries to motorcycle riders are head injuries, followed by upper torso and leg injuries. Wearing a helmet is an important safety measure in reducing the risk of a serious traumatic brain injury.

A Victorian study of 222 motorcycle crashes found that road surface features likely to impair traction were present at 53% of crash sites and directly contributed to 15% of the crashes. Drivers without helmets are 6 times more likely to suffer severe brain injury compared to helmeted riders. Alcohol consumption, fatigue, distraction and mental exhaustion can all affect the riding task.

Our lawyers are experienced in handling motorbike accident claims. If you would like free advice, please call our helpline or complete the online Contact Form.

Cyclist Accidents

Misjudgment by a cyclist or the driver of a motor vehicle is often a major factor in road crashes, as is a failure to observe traffic signals or road signs. Since the 1990s, cyclist deaths in road crashes have constituted on average between 2 and 3 per cent of the total deaths in road crashes in Australia. One national study concluded that in over 60 per cent of crashes, the cyclist was deemed to be ‘responsible’ for the action that precipitated the fatal crash. This was particularly the case in crashes at intersections where the cyclist was either riding through the intersection on the road or moving from the footway onto the intersection. Cyclists were also found to be primarily responsible in other crashes where the cyclist moved from the footway to the road.

Our solicitors are available to provide advice on all aspects of compensation claims involving cyclists.

Pedestrian Accidents

Pedestrian accidents can be caused by visual obstructions from traffic; pedestrians affected by drugs or alcohol; impairment of the pedestrian (in mind or body or in the senses); lack of attention by the pedestrian; distraction. Sometimes a pedestrian is an innocent bystander on a footpath, and is hit by a motor vehicle that is out of control mounting the footpath.

When an unprotected pedestrian is hit by any kind of motor vehicle, the pedestrian can suffer catastrophic injuries, such as a head injury, spinal cord damage, fractures, internal injuries, and even death.

We understand how traumatic these accidents and injuries can be, and we believe that injured victims are entitled to maximum financial compensation for their various losses.
