Making A Claim

Drivers

As a driver of a motor vehicle involved in a crash where someone is injured or killed, you are required by law to provide the following details to any other driver or person injured in the crash (or their representative):

  • Your name and address.
  • The name and address of the owner (registered operator) of the vehicle being driven by you.
  • Your vehicle’s registration number.
  • Any other information necessary to identify your vehicle.

This information should be provided at the scene of the accident or as soon as possible. You should also let any other driver or person injured in the motor accident know the CTP (compulsory third party) insurer for the vehicle being driven by you. You should not admit liability or promise payment.

The CTP insurance scheme covers personal injury compensation claims made by injured road users. As an injured driver, you may claim compensation from the insurer of the owner/driver of the 'at-fault' vehicle (if negligence can be established). If you were partly liable for causing the accident, you can still claim compensation but the compensation you are entitled to will be reduced to reflect your share of liability.
